1. Services
Fine Apps Co. provides custom mobile application development services for local businesses. Services may include but are not limited to:
- Custom mobile app design and development
- App Store and Google Play submission and setup
- Loyalty and rewards system integration
- Mobile ordering functionality
- Push notification setup
- Owner-facing dashboard for self-service menu and content updates
- Ongoing hosting, maintenance, and technical support
The specific scope of services for each project will be agreed upon in writing between Fine Apps Co. and the client prior to work beginning.
2. Quotes & Payment
All pricing is provided on a per-project basis following an initial consultation. A written quote will be issued outlining the scope of work and associated costs before any work begins.
Payment terms will be specified in the project agreement and may include:
- A deposit due before work begins
- A final payment due upon project completion and before deployment
- A recurring monthly maintenance fee if applicable
Work will not begin until the agreed deposit has been received. Fine Apps Co. reserves the right to pause or suspend work if payments are not made according to agreed terms.
3. App Store Accounts
Fine Apps Co. will manage app submissions and updates on behalf of the client as part of the agreed maintenance plan. The client retains full ownership and control of their App Store accounts at all times.
4. Ownership & Intellectual Property
Upon receipt of full payment, the client owns the completed app and all custom assets created specifically for their project, including logos, UI designs, and branding elements provided by the client.
Fine Apps Co. retains the right to:
- Reference the completed project in our portfolio
- Use the project as a demonstration of our capabilities to prospective clients
Any third-party libraries, frameworks, or tools used in development remain subject to their respective licenses.
5. Client Responsibilities
The client agrees to:
- Provide all necessary content, branding materials, and information in a timely manner
- Review and approve work within a reasonable timeframe when requested
- Create and maintain their own App Store and Google Play accounts
- Pay all applicable App Store and hosting fees associated with their accounts
- Notify Fine Apps Co. promptly of any issues or changes needed
6. Maintenance & Support
Ongoing maintenance services are optional and billed on a recurring monthly basis as agreed. Maintenance includes hosting support, bug fixes, minor content updates, and App Store submission management.
Either party may cancel the maintenance agreement with 30 days written notice. Upon cancellation, Fine Apps Co. will provide the client with all necessary files and credentials to continue independently or transition to another provider.
Fine Apps Co. is not responsible for issues caused by third-party platform changes (such as App Store policy updates) that require significant redevelopment beyond normal maintenance scope.
7. Revisions
The number of revisions included in each project will be specified in the project agreement. Revisions beyond the agreed scope may be subject to additional fees, which will be communicated and agreed upon before work proceeds.
8. Turnaround & Timelines
Project timelines will be estimated and communicated at the time of agreement. Fine Apps Co. will make reasonable efforts to meet agreed timelines, however delays may occur due to client response times, third-party platform reviews (such as App Store approval), or factors outside our control.
Fine Apps Co. is not liable for losses resulting from project delays caused by circumstances beyond our reasonable control.
9. Limitation of Liability
Fine Apps Co. is not liable for any indirect, incidental, or consequential damages arising from the use of a delivered app, including but not limited to lost revenue, data loss, or service downtime.
Our total liability to any client shall not exceed the total amount paid to Fine Apps Co. for the specific project in question.
10. Termination
Either party may terminate a project agreement with written notice. In the event of termination:
- The client is responsible for payment of all work completed up to the termination date
- Fine Apps Co. will deliver all completed work and files to the client upon receipt of outstanding payment
- Deposits are non-refundable once work has begun
11. Governing Law
These Terms of Service are governed by the laws of the State of Texas. Any disputes arising from these terms or from services provided by Fine Apps Co. shall be resolved in the courts of Bexar County, Texas.
12. Changes to These Terms
Fine Apps Co. reserves the right to update these Terms of Service at any time. Updated terms will be posted on this page. Continued engagement with our services after changes are posted constitutes acceptance of the revised terms.
